Un’eredità
da sistemare,
in ordine.
An estate
to settle,
in the right order.

A will that leaves someone out, an account emptied before or after death, debts nobody knew about, a house nobody wants to sell and nobody can buy. In succession matters the order of the moves counts as much as the law: some deadlines run from day one and some well-meant steps cannot be undone. We assist heirs and families in Bologna and Milan, from the first reading of the papers to the division.

Accepting, renouncing or accepting with benefit of inventory are choices with different and partly irreversible effects. The first mistake is often a well-meant step: paying a debt of the deceased from their account, collecting and selling their car, letting their house. These may amount to tacit acceptance and close off renunciation.

That is why the first meeting puts the facts in order: who the heirs are, what is in the estate, what left it before death and which deadlines are already running.

non ci si parla più.

When the family
stops talking.

In most contested successions there is one knot: a sibling who received more during the parent’s life, an account managed by whoever cared for the parent, a house occupied by one of the heirs. We reconstruct the movements, quantify the shares and look for agreement first, in mediation or at the table, keeping litigation ready if needed.

Quattro passi, dalle carte

Four steps, from the papers
to the division.

01

Primo incontro

First meeting

Tell us about the family and the succession, with the documents you have: will, succession return, bank statements. A confidential meeting to see at once whether any deadline is close.

02

Ricostruzione dell’asse

Reconstructing the estate

We identify the heirs and forced heirs and reconstruct assets, debts, accounts and lifetime gifts. Every later choice depends on this account.

03

Le strade, con i costi

The routes, with their costs

Accept or renounce, claim reduction, propose a division: we set out the solutions with the risks and costs of each and a written estimate. The family decides.

04

Accordo o causa

Agreement or litigation

We look for agreement among co-heirs, including in the mandatory mediation before a division action; failing that, we act in division, reduction or restitution proceedings.

Tre situazioni ricorrenti nelle successioni familiari. Raccontaci a che punto sei.

Three recurring situations in family successions. Tell us where you stand.

TestamentoWill01
Testamento e quota di legittima
Wills and the reserved share

The spouse, the children and, failing them, the parents are entitled to a reserved share (arts. 536 et seq. of the Civil Code). If the will or lifetime gifts reduce it, a reduction claim is available.

Before that, the will itself must be read: whether it is formally valid, what it actually provides and whether later wills exist. A handwritten will must be entirely written, dated and signed by the testator (art. 602).

Conti e donazioniAccounts and gifts02
The emptied account and lifetime gifts

Withdrawals from a parent’s account, purchases in a child’s name, money given towards a house: these may be gifts, including indirect ones, to be brought back into the estate by collation (art. 737) or taken into account for the reserved share.

The work starts from the bank statements and the movements of recent years. Joint accounts are presumed to be held in equal shares, a presumption that can be rebutted by proving who paid the money in.

Debiti e divisioneDebts and division03
Eredità con debiti, casa da dividere
Estates with debts, a house to divide

If debts exceed assets, renunciation (art. 519) or acceptance with benefit of inventory (art. 484) protect the heir’s own assets, provided no act amounting to acceptance has been done first.

Where the estate is solvent but the co-heirs disagree, each may request division (art. 713). A property that cannot conveniently be divided is allotted to one heir with a cash adjustment or sold (art. 720), after the mandatory attempt at mediation.

Successioni:
le domande frequenti.

Succession:
frequently asked questions.

The will leaves me out or gives me little: what can I do?

Who is entitled to a reserved share — the spouse, the children and, if there are no children, the parents — cannot be deprived of it by a will or by lifetime gifts (arts. 536 et seq. of the Civil Code). Where the share is infringed, a reduction claim is available (arts. 553 et seq.), subject to a ten-year limitation period whose starting point must be checked case by case. A will may also be invalid, for example a handwritten will not entirely written, dated and signed by the testator (art. 602) or made by someone lacking capacity (art. 591).

A relative withdrew money from a parent’s account: can it be recovered?

It depends on when and on what basis. Withdrawals after death concern money belonging to all the heirs and must be returned or counted in the division. Earlier withdrawals may be gifts, including indirect ones, to be brought back into the estate by collation (art. 737) or taken into account for the reserved share; or withdrawals without title, giving rise to a restitution claim. The first step is documentary: the bank statements, which an heir can as a rule obtain from the bank.

The estate has more debts than assets: what is the best course?

The options are renunciation (art. 519), declared before a notary or the court registry, and acceptance with benefit of inventory (art. 484), which limits liability for debts to the value of the assets received. Whoever renounces is treated as never having been called to inherit (art. 521) and is not liable for the deceased’s debts. Beware of what is done in the meantime: selling an asset of the deceased, using the account or disposing of the house may amount to tacit acceptance (art. 476). Those in possession of the estate also face short deadlines for the inventory (art. 485).

An inherited house and co-heirs who disagree: what is the way out?

Until the estate is divided, the house is co-owned by the heirs. Each co-heir may request division at any time (art. 713), save for the special cases provided by law. If the property cannot conveniently be divided, it may be allotted to one co-heir with a cash adjustment to the others, or sold (art. 720). Before a division action, an attempt at mediation is mandatory: that is often where agreement is found, at far lower time and cost than litigation.

How do we start, and what does it cost?

We start with a confidential first meeting, in Bologna or Milan or by video call, with the documents available: will, succession return, bank statements, land registry records. After reviewing them we set out the possible routes, with the risks and costs of each, and provide a written estimate. The choice stays with the family.
