A parent dies leaving more debts than assets. The son renounces the inheritance before the court registrar and believes the matter is closed. Years later a notice of forthcoming mortgage registration on his home arrives. By order no. 24651 of 14 August 2026 the Court of Cassation restates that renunciation removes the effects of the call to the estate retroactively, and that its theoretical revocability does not allow the creditor to act as though the person renouncing were already an heir.
Il caso
The case
The taxpayer had received notice of a forthcoming mortgage registration based on several payment demands: one for his own debts, the others for his mother’s, which he was called on to meet as a co-heir. Before the tax court he raised one simple fact: he had renounced his mother’s estate, by a deed completed on 12 June 2017.
He succeeded at first instance and on appeal. As to the inherited debts, the courts ruled out any liability of the taxpayer by effect of the renunciation; as to the demand relating to his own debts, they noted that the amount, below EUR 20,000, does not allow a mortgage to be registered.
The authority appealed to the Court of Cassation arguing, in substance, that renunciation is not enough: until the right to accept is time-barred, renunciation remains revocable under art. 525 of the Civil Code, and the creditor must be able to protect itself.
The Court dismissed the appeal and ordered the Revenue Agency to pay the costs of the proceedings, assessed at EUR 8,400.00 in fees and EUR 200.00 in disbursements, plus statutory additions.
Il principio: la rinuncia retroagisce
The principle: renunciation operates retroactively
Liability for the deceased’s debts presupposes having taken on the status of heir. Under art. 521 of the Civil Code renunciation operates retroactively: the person renouncing is treated as never having been called to the estate.
Hence the consequence the Court draws from its own case law:
That is the point which matters most to anyone holding a payment demand: the finality of the tax act is not enough to found the liability of someone who never took on the status of heir.
The absence of any assumption of liability can be raised directly when challenging the payment demand, as the Court of Cassation restated by referring, among others, to its own order no. 37064/2022.
Revocability of the renunciation is not an argument
The creditor’s argument was subtler than it looks: renunciation can be revoked until the right to accept is time-barred, so, as a rule, for ten years the possibility remains that the person who renounced becomes an heir. In the meantime, on the authority’s case, it must be possible to interrupt the limitation periods running on the tax claims.
The Court defuses it with a structural point: renunciation may also come after the ten-year period has run, and in that case its only effect is to confirm that there never was any acceptance. Steps taken to interrupt limitation against the person renouncing would therefore be pointless.
The mere possibility that the renunciation may later be revoked is not enough to confer, in the meantime, the status of heir on the person who renounced.
Nor is the creditor necessarily without protection: the Court points to the ordinary remedies available, including the challenge to the renunciation under art. 524 of the Civil Code, where of course its conditions are met.
A less obvious angle: the creditor lost on procedure, not on substance
In its appeal the authority had also put forward a potentially decisive point: the taxpayer was said to have had the estate’s assets at his disposal, a circumstance which, on the authority’s case, would have amounted to tacit acceptance of the inheritance.
The Court, however, does not examine the point on its merits: it did not appear in the notice of appeal and was raised before the judges only at the final stage.
Two readings are worth holding together here.
For anyone advising the person called to the estate, the ruling is less reassuring than it may appear: the real risk is not so much the creditor challenging the renunciation as a matter of law, but what that person has actually done with the estate’s assets.
Collecting rent, selling a car, drawing on the deceased’s bank account: depending on the circumstances, these are acts that may amount to tacit acceptance under art. 476 of the Civil Code.
That is not all. A person called to the estate who is in possession of its assets must observe the specific deadlines set by art. 485 of the Civil Code for drawing up the inventory, at the risk of otherwise being treated as an heir without limitation.
For those advising the creditor the mirror image applies. The facts from which the acquisition of the status of heir can be inferred must be pleaded and proved in good time before the trial courts, or the other remedies allowed by law must be considered, where their conditions are met. Pressing a revocability that stays merely theoretical is not enough.
The Court also notes, almost in passing, that it is hard to see why the authority chose to proceed by way of a mortgage-registration notice. An incidental remark, but a telling one, which draws attention to the proper choice of remedy as well.
Che cosa farne, in pratica
What to do with it, in practice
When a succession opens with an uncertain liability side, the choice is not necessarily between accepting and renouncing with nothing further to weigh.
The main alternatives are renunciation and acceptance with benefit of inventory. The first means giving up the possibility of taking the estate’s assets, save for a later acceptance within the limits the law allows; the second keeps the two estates separate and limits liability for the inherited debts within the terms set by the rules on benefit of inventory, but requires specific steps and deadlines to be met.
Waiting can be a choice too, but only after the actual situation has been checked. The mere passage of time does not always protect: someone in possession of the estate’s assets may become an heir without limitation through failure to meet the statutory deadlines, while certain conduct may amount to tacit acceptance.
Four points to check at once. The date the succession opened and any steps already taken in relation to the assets, because different deadlines and consequences run from there. The list of transactions carried out after the death, even apparently marginal ones: that is the ground on which tacit acceptance may be fought. The picture of the liabilities, including tax debts already assessed against the deceased and any claims arising later. Finally, the formal regularity of the renunciation and the safekeeping of the related documents, to be produced in good time whenever liability for the inherited debts is asserted.
The conclusion is a simple one: renouncing an inheritance can protect against the deceased’s debts, but it must be checked that the status of heir has not already been taken on, even unwittingly.
