Nel preliminare era scritto che il villino era stato «edificato in data anteriore al primo settembre 1967». Le verifiche tecniche avviate in vista del rogito hanno però fatto emergere un portico, un’autorimessa e un ulteriore volume realizzati nel 2012 e nel 2013, senza titolo edilizio e risultati non sanabili. A realizzarli era stata la stessa venditrice. Con la sentenza 27 agosto 2026 n. 32131, la Cassazione penale ha dichiarato inammissibile il suo ricorso, rendendo definitiva la condanna per truffa aggravata.
The preliminary contract stated that the villa had been “built before 1 September 1967”. The technical checks started in view of the final deed brought to light a porch, a garage and a further volume built in 2012 and 2013, without any building permit and beyond regularisation. They had been built by the seller herself. By judgment no. 32131 of 27 August 2026 the Criminal Division of the Court of Cassation declared her appeal inadmissible, making the conviction for aggravated fraud final.

La vicenda decisa dalla Corte di cassazione, seconda sezione penale, con la sentenza 27 agosto 2026 n. 32131 ha una sequenza che chi compra casa riconosce subito.
The case decided by the Court of Cassation, Second Criminal Division, in judgment no. 32131 of 27 August 2026 follows a sequence that anyone who has bought a home will recognise at once.
Una proprietaria promette in vendita un villino a due acquirenti. Nel contratto preliminare viene dichiarato che l’immobile è stato edificato in data anteriore al 1° settembre 1967 ed è allegata la relativa planimetria. Gli acquirenti, sulla base della documentazione ricevuta, avviano le verifiche tecniche necessarie in vista del rogito.
An owner agrees to sell a villa to two buyers. The preliminary contract states that the property was built before 1 September 1967, and the relevant floor plan is attached. On the basis of the documentation received, the buyers start the technical checks needed in view of the final deed.
Le verifiche raccontano però un’altra storia: accanto al corpo principale risultano un portico, un’autorimessa e un ulteriore volume, realizzati dalla stessa venditrice negli anni 2012 e 2013 senza titolo edilizio. Le opere risultano abusive e non sanabili e modificano la consistenza dell’immobile rispetto alla documentazione rappresentata agli acquirenti.
The checks tell a different story: next to the main building there are a porch, a garage and a further volume, built by the seller herself in 2012 and 2013 without any building permit. The works are unlawful and cannot be regularised, and they alter the size of the property compared with the documentation presented to the buyers.
Il Tribunale assolve la venditrice, ritenendo non provato il dolo e valorizzando la circostanza che ella avrebbe riprodotto quanto dichiarato dal proprio dante causa.
The trial court acquits the seller, finding intent unproven and giving weight to the fact that she had reproduced what her own predecessor in title had declared.
La Corte d’appello ribalta la decisione e pronuncia condanna per truffa aggravata, riconoscendo anche una provvisionale agli acquirenti costituiti parte civile.
The Court of Appeal reverses that decision and convicts her of aggravated fraud, also awarding an interim payment to the buyers, who had joined the proceedings as civil parties.
La Cassazione dichiara infine inammissibile il ricorso. Il punto decisivo è semplice: la venditrice poteva eventualmente invocare quanto riferito dal precedente proprietario rispetto al fabbricato originario, ma non rispetto alle opere che aveva realizzato personalmente nel 2012 e nel 2013. Su quelle opere non poteva non conoscere la reale situazione.
The Court of Cassation finally declares the appeal inadmissible. The decisive point is simple: the seller might have relied on what the previous owner had told her as regards the original building, but not as regards the works she had carried out herself in 2012 and 2013. About those works she could not have been unaware of the real position.

Why the “pre-1967” formula weighs more than it seems
Chi non si occupa abitualmente di immobili può leggere l’espressione «ante 1967» come una semplice formula tecnica. Non lo è.
Those who do not deal with property on a regular basis may read “pre-1967” as a mere piece of technical wording. It is not.
L’art. 40 della legge 28 febbraio 1985 n. 47 prevede, per le opere la cui costruzione sia iniziata prima del 1° settembre 1967, la possibilità di sostituire negli atti di trasferimento gli estremi del titolo edilizio con una dichiarazione dell’alienante relativa all’epoca di costruzione.
Article 40 of Law no. 47 of 28 February 1985 allows, for works whose construction began before 1 September 1967, the details of the building permit to be replaced in deeds of transfer by a declaration of the seller as to the time of construction.
La disciplina deve essere coordinata con quella oggi contenuta nel d.P.R. 6 giugno 2001 n. 380, e in particolare con le disposizioni sulla nullità degli atti di trasferimento privi delle menzioni urbanistiche richieste.
That regime must be read together with the rules now contained in Presidential Decree no. 380 of 6 June 2001, and in particular with the provisions on the nullity of deeds of transfer lacking the required planning statements.
Questo, però, non significa che un immobile «ante 1967» sia automaticamente urbanisticamente regolare, né che prima di quella data fosse sempre possibile costruire senza titolo. La necessità della licenza edilizia esisteva già, in determinate aree, in forza della legge urbanistica del 1942 e poteva derivare anche dalla disciplina locale.
This does not mean, however, that a “pre-1967” property is automatically compliant with planning rules, nor that before that date it was always possible to build without a permit. In certain areas a building licence was already required under the 1942 planning act, and the requirement could also arise from local rules.
La dichiarazione sull’epoca di costruzione ha quindi una precisa funzione nel regime formale degli atti di trasferimento, ma non equivale a una certificazione generale della piena conformità urbanistica dell’immobile.
The declaration on the time of construction therefore performs a precise function within the formal regime of deeds of transfer, but it is not a general certificate of the property’s full planning compliance.
Ed è proprio per questo che una dichiarazione consapevolmente falsa sulla storia edilizia del bene può assumere un peso decisivo nei rapporti tra venditore e acquirente.
And it is precisely for this reason that a knowingly false declaration about the building history of the property can carry decisive weight in the relationship between seller and buyer.
Dal civile al penale: dove sta il confine
From civil to criminal: where the line runs
La presenza di un abuso edilizio, di per sé, non integra automaticamente il delitto di truffa.
The existence of a building violation does not, in itself, automatically amount to the offence of fraud.
L’abuso può avere una propria rilevanza amministrativa e, nei casi previsti dalla legge, anche penale sul piano urbanistico. Sul versante civilistico, inoltre, possono entrare in gioco differenti rimedi: garanzie contrattuali, mancanza di qualità promesse o essenziali, inadempimento, riduzione del prezzo, risoluzione e risarcimento del danno.
The violation may have its own administrative relevance and, in the cases provided for by law, criminal relevance under planning legislation as well. On the civil side, different remedies may come into play: contractual warranties, the lack of promised or essential qualities, breach, price reduction, termination and damages.
Quanto alla nullità urbanistica degli atti traslativi, le Sezioni Unite della Cassazione, con la sentenza 22 marzo 2019 n. 8230, l’hanno qualificata come nullità «testuale», legata alla mancanza nell’atto delle menzioni richieste dalla legge o alla loro riferibilità ad un titolo inesistente o non relativo all’immobile.
As to the planning nullity of deeds of transfer, the Joint Divisions of the Court of Cassation, in judgment no. 8230 of 22 March 2019, classified it as a “textual” nullity, tied to the absence in the deed of the statements required by law or to their referring to a permit that does not exist or does not relate to the property.
Il contratto preliminare, avendo effetti obbligatori e non direttamente traslativi, resta invece normalmente fuori dal perimetro di questa speciale nullità urbanistica.
The preliminary contract, which produces obligations rather than a direct transfer, normally remains outside the scope of this special planning nullity.
Il passaggio dalla patologia civilistica alla truffa si verifica su un piano diverso.
The step from a civil defect to fraud takes place on a different plane.
Occorre accertare se il comportamento del venditore, attraverso dichiarazioni false, artifici, raggiri o anche reticenze dotate in concreto di efficacia ingannatoria, abbia indotto l’altra parte in errore procurando un ingiusto profitto con altrui danno.
What must be established is whether the seller’s conduct, through false statements, artifice, deceit or even silence capable in the circumstances of misleading, induced the other party into error, procuring an unjust profit to another’s detriment.
Nel caso deciso dalla Cassazione n. 32131/2026 l’elemento particolarmente significativo era costituito da una dichiarazione contrattuale scritta e consapevolmente falsa, relativa ad un immobile che comprendeva opere recenti realizzate dalla stessa venditrice.
In the case decided by the Court of Cassation in judgment no. 32131/2026 the particularly significant element was a written and knowingly false contractual statement, concerning a property that included recent works carried out by the seller herself.
Non è però la forma scritta, in assoluto, a segnare il confine con il reato: ciò che conta è l’idoneità del comportamento complessivo a creare nella controparte una falsa rappresentazione della realtà e a determinarne le scelte negoziali.
It is not the written form as such, however, that marks the boundary with the offence: what counts is whether the overall conduct is capable of creating a false picture of reality in the other party and of shaping its contractual choices.
La difesa che non ha funzionato
The defence that did not work
La linea difensiva era intuitiva: la venditrice avrebbe semplicemente ripetuto ciò che le era stato dichiarato quando, a sua volta, aveva acquistato l’immobile.
The line of defence was intuitive: the seller had merely repeated what she had been told when she, in turn, bought the property.
L’argomento poteva avere una sua logica rispetto alla storia del fabbricato originario. Non poteva però spiegare le opere realizzate successivamente dalla stessa proprietaria.
The argument had a logic of its own as regards the history of the original building. It could not, however, account for the works later carried out by the owner herself.
Se il venditore costruisce personalmente un portico o un’autorimessa nel 2012 o nel 2013, difficilmente può sostenere di avere fatto affidamento sulle dichiarazioni rese anni prima dal proprio dante causa circa l’originaria epoca di costruzione dell’immobile.
If a seller personally builds a porch or a garage in 2012 or 2013, it is hard to maintain that she relied on statements made years earlier by her predecessor in title about the original date of construction of the property.
È proprio questa conoscenza diretta ad assumere, nella ricostruzione dei giudici di merito condivisa dalla Cassazione, un peso decisivo nella prova della consapevolezza dell’inganno.
It is precisely this first-hand knowledge that, in the reconstruction of the lower courts endorsed by the Court of Cassation, carries decisive weight in proving awareness of the deception.
Sul piano processuale, la Suprema Corte ha inoltre ritenuto adeguata la motivazione rafforzata resa dalla Corte d’appello per giustificare il ribaltamento della precedente assoluzione. Anche le censure relative alla rinnovazione dell’istruttoria e al travisamento della prova non hanno superato il vaglio di ammissibilità.
Procedurally, the Supreme Court also found adequate the reinforced reasoning given by the Court of Appeal to justify reversing the earlier acquittal. The complaints concerning the re-hearing of evidence and the alleged misreading of the evidence likewise failed the admissibility test.
Tre aspetti che spesso vengono sottovalutati
Three aspects that are often underestimated
La planimetria non è un allegato neutro. Quando viene richiamata o allegata al contratto per identificare e rappresentare il bene, contribuisce alla descrizione dell’immobile offerta alla controparte. Lo scarto tra la consistenza risultante dalla planimetria e lo stato reale dei luoghi può quindi diventare uno degli elementi utili per ricostruire ciò che è stato rappresentato all’acquirente.
The floor plan is not a neutral attachment. Where it is referred to or attached to the contract in order to identify and describe the property, it forms part of the picture offered to the other party. The gap between the size shown on the plan and the actual state of the premises can therefore become one of the elements used to reconstruct what was represented to the buyer.
La responsabilità penale e la validità civilistica del trasferimento non coincidono. Questo è probabilmente l’aspetto più interessante della vicenda. La presenza di modifiche abusive successive non comporta necessariamente, da sola, la nullità del trasferimento di un immobile effettivamente costruito prima del 1° settembre 1967.
Criminal liability and the civil validity of the transfer do not coincide. This is probably the most interesting aspect of the case. The existence of later unlawful alterations does not necessarily, on its own, make void the transfer of a property genuinely built before 1 September 1967.
La Cassazione civile ha ribadito anche recentemente che, ai fini della speciale nullità urbanistica, occorre verificare la presenza nell’atto delle dichiarazioni e menzioni richieste dalla legge e la loro concreta riferibilità all’immobile.
The Civil Division of the Court of Cassation has confirmed again recently that, for the purposes of the special planning nullity, what must be checked is the presence in the deed of the declarations and statements required by law and whether they actually relate to the property.
Ciò significa che un immobile può non essere necessariamente «incommerciabile» sul piano civilistico e, nello stesso tempo, la falsa o ingannevole rappresentazione della sua situazione urbanistica può assumere autonoma rilevanza penale nei rapporti tra le parti.
This means that a property may not necessarily be “unmarketable” as a matter of civil law and, at the same time, a false or misleading representation of its planning position may have separate criminal relevance in the relationship between the parties.
Sono due piani diversi e non vanno sovrapposti.
These are two distinct planes and they should not be conflated.
Per chi compra, arrivare alla condanna penale significa comunque essere arrivati troppo tardi. Una sentenza penale definitiva e una provvisionale possono intervenire anni dopo, quando l’affare è ormai saltato o il rapporto tra le parti è definitivamente compromesso.
For the buyer, reaching a criminal conviction still means having arrived too late. A final criminal judgment and an interim award may come years later, when the deal has already collapsed or the relationship between the parties is beyond repair.
Il vero valore pratico della decisione è quindi nel momento precedente alla controversia: conferma quanto sia importante effettuare le verifiche tecniche prima di assumere obblighi contrattuali difficilmente reversibili.
The real practical value of the decision therefore lies upstream of the dispute: it confirms how important it is to carry out technical checks before taking on contractual obligations that are hard to unwind.
Nel caso concreto gli acquirenti hanno svolto le verifiche dopo il preliminare e prima del rogito, facendo emergere le criticità prima del trasferimento definitivo.
In this case the buyers carried out their checks after the preliminary contract and before the final deed, bringing the problems to light before the transfer was completed.
Ancora meglio sarebbe svolgere queste verifiche prima della firma del preliminare o subordinare espressamente l’efficacia dell’operazione all’esito positivo della verifica urbanistica e catastale.
Better still would be to carry out those checks before signing the preliminary contract, or to make the operation expressly conditional on a positive outcome of the planning and cadastral checks.
Che cosa fare, in concreto
What to do, in practice
Chi compra. È opportuno richiedere una verifica tecnica della situazione urbanistica e catastale dell’immobile prima di sottoscrivere il preliminare oppure inserire nel contratto una clausola che condizioni la prosecuzione dell’operazione all’esito positivo delle verifiche, disciplinando con precisione termini, caparra ed eventuale restituzione delle somme versate. La planimetria catastale deve essere confrontata con lo stato dei luoghi e con la documentazione edilizia. La presenza di corpi di fabbrica o trasformazioni evidentemente più recenti rispetto all’edificio originario merita sempre uno specifico approfondimento.
Chi vende. La dichiarazione relativa alla storia edilizia dell’immobile deve essere trattata come un’affermazione della quale si assume la responsabilità. Se esistono opere prive di titolo o situazioni urbanistiche dubbie, la prima attività dovrebbe essere una verifica tecnica sulla loro natura, sullo stato legittimo dell’immobile, sull’eventuale sanabilità e sulle condizioni alle quali il trasferimento possa essere validamente stipulato. La semplice comunicazione dell’esistenza dell’abuso non rende automaticamente possibile ciò che la legge eventualmente impedisca di trasferire; evita però che la trattativa si fondi su una rappresentazione non corrispondente alla realtà.
Chi assiste la trattativa. Agenti immobiliari, avvocati, notai e tecnici hanno tutto l’interesse a fare della verifica preventiva una fase ordinaria dell’operazione. L’obiettivo non è soltanto evitare la nullità dell’atto. È soprattutto fare in modo che le parti sappiano esattamente quale immobile stanno vendendo o acquistando e quali criticità stanno assumendo.
Buyers. It is advisable to ask for a technical check on the planning and cadastral position of the property before signing the preliminary contract, or to include a clause making the continuation of the operation conditional on a positive outcome of those checks, setting out precisely the deadlines, the deposit and any return of the sums paid. The cadastral plan should be compared with the state of the premises and with the building documentation. Structures or alterations that are visibly more recent than the original building always deserve specific investigation.
Sellers. The declaration on the building history of the property should be treated as an assertion for which responsibility is assumed. Where there are works without a permit or doubtful planning situations, the first step should be a technical assessment of their nature, of the lawful state of the property, of any prospect of regularisation and of the terms on which the transfer may validly be executed. Simply disclosing the violation does not automatically make possible what the law may prevent from being transferred; it does, however, keep the negotiation from resting on a picture that does not match reality.
Those assisting the negotiation. Estate agents, lawyers, notaries and technical advisers have every interest in making the preliminary check an ordinary stage of the transaction. The aim is not only to avoid the nullity of the deed. It is above all to ensure that the parties know exactly which property they are selling or buying and which problems they are taking on.

La sentenza n. 32131/2026 non introduce un principio rivoluzionario: la giurisprudenza penale riconosce da tempo che una falsa o ingannevole rappresentazione della situazione urbanistica di un immobile può, quando ricorrono tutti gli elementi dell’art. 640 c.p., integrare il delitto di truffa.
Judgment no. 32131/2026 introduces no revolutionary principle: criminal case law has long recognised that a false or misleading representation of the planning position of a property may, where all the elements of Article 640 of the Criminal Code are present, amount to fraud.
Il valore della decisione sta soprattutto nella chiarezza del caso concreto.
The value of the decision lies above all in the clarity of the facts.
Una dichiarazione apparentemente di routine. Alcune opere abusive realizzate personalmente dalla venditrice molti anni dopo il 1967. Una rappresentazione dell’immobile risultata incompatibile con ciò che la stessa venditrice necessariamente conosceva.
An apparently routine statement. Unlawful works built by the seller herself many years after 1967. A picture of the property that turned out to be irreconcilable with what the seller necessarily knew.
E una difesa fondata sulla buona fede derivante dalle dichiarazioni del precedente proprietario che non può funzionare quando ad essere contestate sono opere costruite successivamente da chi oggi vende.
And a defence resting on good faith derived from the previous owner’s statements, which cannot work where the works complained of were built later by the person now selling.
La lezione più utile è forse proprio questa: la commerciabilità civilistica dell’immobile e la correttezza della rappresentazione resa all’acquirente sono questioni diverse. Anche quando l’atto possa astrattamente essere stipulato, il venditore non è libero di rappresentare in modo falso o ingannevole la reale situazione del bene.
The most useful lesson is perhaps precisely this: the civil marketability of the property and the accuracy of the picture given to the buyer are different questions. Even where the deed can in principle be executed, the seller is not free to represent the real position of the property falsely or misleadingly.
