When an assessment notice or a payment demand arrives, the first question is not whether to challenge it, but whether challenging it pays. There are usually three routes — settle, pay by instalments, litigate — with different costs, timing and risk. Our job is to put them on the table with the figures, say which one we would take and why, and leave the decision to the person who has to pay.
Di cosa ci occupiamo
What we handle
Accertamento e contenzioso.
Assessment and litigation. Assessment notices, payment demands and injunctions, settlement with the tax authority, administrative appeals and court proceedings. We start from the formal regularity of the act: service, reasoning, time limits, the right to be heard. Where these are missing, they often decide the case before the merits.
Relief schemes and instalment plans. Where the claim stands up, the question becomes how much and when: settlement, conciliation, statutory relief schemes, instalment plans and their forfeiture. Here the usual mistake is not legal but a matter of dates.
Liability of directors, liquidators and shareholders. Company debt reaching individuals: dissolved or liquidating companies, former shareholders served with assessments, liquidators called to answer for unpaid taxes.
Social security demands. INPS claims and debit notices, which follow their own rules and shorter deadlines.
Non-profit entities. Commercial or non-commercial classification, direct and indirect taxation, mandatory books, inspections.
Chi segue la materia
Who handles this area
Tax matters are handled by Andrea Bugamelli, Of Counsel, admitted before the Supreme Court and the higher courts and trained at the two-year advanced school of the National Union of Tax Lawyers. On the corporate side he works alongside the lawyers who follow the contract and the company, because an assessment almost always starts from a transaction someone drafted earlier.
We also handle the certification of the Tax Control Framework, the tax risk management system required for the cooperative compliance regime.
