Chi vende online ai consumatori ha, dal 19 giugno 2026, un obbligo tecnico nuovo: mettere a disposizione una funzione di recesso “one-click”, tanto semplice quanto lo è il pulsante di acquisto. Lo prevede il Dlgs 31 dicembre 2025, n. 209, che riscrive alcuni passaggi del Codice del Consumo. La sanzione per chi non si adegua arriva fino a dieci milioni di euro. Vale la pena capire cosa cambia davvero, prima che sia un reclamo a farlo notare.
From 19 June 2026, businesses selling online to consumers face a new technical duty: to provide a “one-click” withdrawal function, as simple as the purchase button itself. This is set out in Legislative Decree no. 209 of 31 December 2025, which rewrites parts of the Consumer Code. Non-compliance can be fined up to ten million euro. It is worth understanding what actually changes, before a complaint points it out.

Recependo la direttiva (UE) 2023/2673, il Dlgs 209/2025 (pubblicato in Gazzetta l’8 gennaio 2026, in vigore dal 23 gennaio, applicabile ai contratti conclusi dopo il 19 giugno 2026) introduce nel Codice del Consumo il nuovo art. 54-bis. Il decreto nasce per la commercializzazione a distanza dei servizi finanziari, ma la portata è più ampia: tocca l’e-commerce B2C nel suo insieme. Per i contratti conclusi tramite interfaccia online, il professionista deve ora consentire al consumatore di recedere anche attraverso una funzione digitale dedicata. Non una facoltà da concedere su richiesta, ma un pulsante che deve esistere.
Transposing Directive (EU) 2023/2673, Legislative Decree 209/2025 (published on 8 January 2026, in force from 23 January, applicable to contracts concluded after 19 June 2026) introduces the new art. 54-bis into the Consumer Code. The decree was designed for the distance marketing of financial services, but its reach is broader: it affects B2C e-commerce as a whole. For contracts concluded through an online interface, the trader must now allow the consumer to withdraw also through a dedicated digital function. Not a right to be granted on request, but a button that must exist.
La funzione deve essere ben visibile e facilmente accessibile per l’intero periodo utile al recesso, contraddistinta da una dicitura inequivocabile (ad esempio “Recedere dal contratto qui”), e deve raccogliere nome del consumatore, dati identificativi del contratto e mezzo elettronico su cui ricevere la conferma. Sono previsti un secondo passaggio di conferma esplicita, per evitare i clic accidentali, e l’invio automatico di un avviso di ricevimento su supporto durevole, con data e ora. Attenzione a un punto pratico: il nuovo canale digitale si aggiunge ai metodi di recesso tradizionali, non li sostituisce.
The function must be clearly visible and easily accessible throughout the withdrawal period, marked by an unambiguous wording (for example “Withdraw from the contract here”), and must collect the consumer’s name, the contract’s identifying data and the electronic means for the confirmation. A second explicit confirmation step is required, to avoid accidental clicks, together with an automatic acknowledgment of receipt on a durable medium, with date and time. One practical point: the new digital channel adds to the traditional methods of withdrawal, it does not replace them.

Il decreto interviene anche sull’art. 49, comma 1, lett. h) del Codice del Consumo, in tema di obblighi informativi precontrattuali. Oltre alle informazioni già dovute, il professionista deve indicare in modo chiaro condizioni, termini e procedure per il recesso, il modulo tipo dell’Allegato I parte B, e, dove esiste, la collocazione della funzione di cui all’art. 54-bis. Qui si nasconde il rischio più concreto. L’informativa omessa o incompleta sul recesso estende il termine per esercitarlo fino a dodici mesi oltre i quattordici giorni ordinari, e può integrare un’omissione ingannevole, quindi una pratica commerciale scorretta.
The decree also amends art. 49(1)(h) of the Consumer Code on pre-contractual information duties. Beyond the information already due, the trader must clearly state the conditions, deadlines and procedures for withdrawal, the model form in Annex I part B, and, where it exists, the location of the art. 54-bis function. This is where the most concrete risk lies. Omitted or incomplete information on withdrawal extends the deadline to exercise it up to twelve months beyond the ordinary fourteen days, and may amount to a misleading omission, hence an unfair commercial practice.

La logica del legislatore è lineare. Se comprare online richiede un clic, anche disdire deve richiederne uno. Il decreto colpisce, di riflesso, i cosiddetti dark pattern: le interfacce costruite per rendere l’acquisto immediato e l’uscita faticosa. L’obiettivo dichiarato è la simmetria tra ingresso e uscita dal contratto, letta come misura di trasparenza e non come mero adempimento formale. Per chi vende, questo sposta il baricentro: la compliance non è una clausola da aggiungere alle condizioni generali, è un requisito che vive dentro il flusso di navigazione del sito.
The rationale is straightforward. If buying online takes one click, cancelling must take one too. The decree indirectly targets so-called dark patterns: interfaces designed to make purchase immediate and exit laborious. The stated aim is symmetry between entering and leaving the contract, read as a transparency measure rather than a mere formality. For sellers, this shifts the centre of gravity: compliance is not a clause to add to the general terms, it is a requirement that lives inside the site’s navigation flow.
Un angolo meno ovvio merita attenzione. L’obbligo del “doppio passaggio” prima dell’invio del recesso non è un fastidio da minimizzare: è una tutela anche per il venditore, perché documenta la volontà del consumatore e riduce i recessi contestati o involontari. Chi progetta il flusso pensando solo a ostacolare l’uscita rischia due volte: la sanzione da un lato, il contenzioso sui recessi mal registrati dall’altro. Vale la pena curare il log della richiesta e la ricevuta automatica come si cura la prova di un pagamento.
A less obvious angle deserves attention. The “two-step” requirement before sending the withdrawal is not a nuisance to minimise: it also protects the seller, because it documents the consumer’s intent and reduces disputed or unintended withdrawals. Anyone designing the flow only to hinder exit risks twice: the fine on one side, litigation over poorly recorded withdrawals on the other. It is worth treating the request log and the automatic receipt the way one treats proof of payment.

Il primo intervento è tecnico-funzionale, e conviene affrontarlo prima del resto. Implementare la funzione di recesso “one-click”, con pulsante ben visibile, flusso a due passaggi, ricevuta automatica e log tracciabile. In parallelo vanno aggiornate le condizioni generali di contratto e va rivista l’informativa precontrattuale, allegando il modulo tipo e indicando dove si trova la funzione di recesso. Ultima verifica, non meno importante: che l’interfaccia non contenga dark pattern capaci di ostacolare o orientare le scelte dell’utente.
The first step is technical and functional, and it is best tackled before the rest. Implement the “one-click” withdrawal function, with a clearly visible button, a two-step flow, an automatic receipt and a traceable log. In parallel, update the general terms and revise the pre-contractual information, attaching the model form and stating where the withdrawal function is located. A final check, no less important: that the interface contains no dark patterns capable of hindering or steering the user’s choices.

La scelta di fondo è tra adeguarsi ora, in modo ordinato, o rincorrere dopo un reclamo o un’istruttoria: la seconda strada costa di più, in denaro e in tempo.
