Applicare il CCNL non basta più: quando l’Ispettorato può chiedere un accordo aziendale

Applying the national collective agreement is no longer enough: when the Labour Inspectorate can require a company-level agreement

Un’azienda applica in modo regolare il CCNL Commercio, paga tutto quello che il contratto prevede e non ha contenziosi aperti con i propri dipendenti. Può ricevere dall’Ispettorato del lavoro un provvedimento che le impone di aprire una contrattazione aziendale per introdurre una voce retributiva che quel CCNL non contempla? Il Consiglio di Stato ha risposto che sì.

A company correctly applies the retail sector national collective agreement, pays everything the agreement provides for and has no pending disputes with its employees. Can the Labour Inspectorate order it to open company-level bargaining in order to introduce a pay item that the agreement does not contemplate? The Council of State has answered that it can.

Il fatto: venti gradi sotto zero e un contratto che non li prevede

The facts: twenty degrees below zero and an agreement that ignores them

Un gruppo di addetti lavora dentro celle refrigerate a temperature comprese tra i venti e i ventiquattro gradi sotto zero. Il documento di valutazione dei rischi dell’azienda, redatto dall’azienda stessa, classifica quell’esposizione come rischio alto. Il CCNL applicato, quello del Commercio, non prevede però alcuna indennità collegata al freddo. L’Ispettorato territoriale del lavoro emette allora una disposizione ai sensi dell’art. 14 del D.Lgs. n. 124/2004: entro tre mesi il datore deve avviare una contrattazione aziendale per riconoscere a quei lavoratori una maggiorazione compresa tra l’otto e il dodici per cento, prendendo come riferimento il diverso CCNL dell’industria alimentare, dove una voce simile esiste.

A group of workers operates inside refrigerated chambers at temperatures between twenty and twenty-four degrees below zero. The company’s own risk assessment document classifies that exposure as high risk. The retail sector agreement applied by the company, however, contains no cold-exposure allowance. The territorial Labour Inspectorate therefore issues a disposizione under art. 14 of Legislative Decree no. 124/2004: within three months the employer must open company-level bargaining to grant those workers an increase of between eight and twelve per cent, using as a benchmark the food industry agreement, where a comparable item does exist.

Il TAR Veneto annulla il provvedimento. Il Consiglio di Stato, sezione terza, con la sentenza n. 4969 del 2026 (pubblicata il 22 giugno 2026), riforma quella decisione e conferma la disposizione, in linea con il proprio precedente n. 2778 del 2024.

The Regional Administrative Court of Veneto annulled the measure. The Council of State, third chamber, in judgment no. 4969 of 2026 (published on 22 June 2026), reversed that decision and upheld the measure, in line with its own precedent no. 2778 of 2024.

Il principio: l’irregolarità non è solo la violazione di una norma

The principle: an irregularity is not only the breach of a rule

Lo snodo è una parola sola. L’art. 14 consente all’organo di vigilanza di impartire disposizioni esecutive a fronte delle «irregolarità rilevate in materia di lavoro e legislazione sociale». La lettura tradizionale legge quella formula in modo strettamente formale: irregolarità uguale violazione di una norma precisa. Il Consiglio di Stato ne dà invece una lettura estensiva e allo stato parrebbe potersi sostenere che vi rientri anche l’inadeguatezza sostanziale della retribuzione rispetto al parametro dell’art. 36 della Costituzione, quando l’organizzazione concreta del lavoro espone i dipendenti a una gravosità che il contratto applicato non remunera.

The whole issue turns on one word. Art. 14 allows the supervisory authority to issue enforceable instructions in the face of «irregularities found in labour and social legislation». The traditional reading is strictly formal: an irregularity means the breach of a specific rule. The Council of State instead reads the wording broadly, and at this stage it would appear that it also covers the substantive inadequacy of pay measured against art. 36 of the Constitution, where the actual organisation of work exposes employees to a burden that the applied agreement does not remunerate.

Un passaggio va sottolineato, perché delimita la portata della pronuncia: l’Ispettorato non ha imposto di applicare un contratto collettivo diverso, né ha fissato d’autorità una voce di paga. Ha usato un meccanismo di coazione indiretta: ha ordinato di aprire un tavolo, indicando il CCNL dell’alimentare come semplice parametro equitativo. La libertà sindacale e negoziale resta, ma il giudice amministrativo la considera bilanciabile con il limite dell’utilità sociale che l’art. 41 della Costituzione pone all’iniziativa economica privata.

One passage deserves emphasis, because it defines the reach of the ruling: the Inspectorate did not order the application of a different collective agreement, nor did it set a pay item by decree. It used a mechanism of indirect compulsion: it ordered the opening of negotiations, pointing to the food industry agreement merely as an equitable benchmark. Freedom of association and of bargaining remains, but the administrative court treats it as capable of being balanced against the limit of social utility that art. 41 of the Constitution places on private economic initiative.

Il rischio che di solito non si vede

The risk that usually goes unnoticed

La prova che ha sostenuto la disposizione non veniva da un’ispezione a sorpresa né da un esposto sindacale. Veniva dal documento di valutazione dei rischi redatto dall’azienda, che qualificava come alto il rischio da esposizione al freddo. È l’angolo controintuitivo della vicenda: il presidio che serve a dimostrare diligenza in materia di sicurezza diventa, sul terreno retributivo, il documento che descrive la gravosità non remunerata. La lezione, va detto subito, non è scrivere valutazioni più vaghe (sarebbe un errore grave, con conseguenze penali proprie). La lezione è che DVR, contratto applicato e cedolino devono raccontare la stessa storia, perché oggi vengono letti insieme.

The evidence supporting the measure came neither from a surprise inspection nor from a union complaint. It came from the risk assessment document drafted by the company itself, which rated cold exposure as a high risk. This is the counter-intuitive angle: the very document meant to show diligence on health and safety becomes, on the pay side, the record describing an unremunerated burden. The lesson, to be clear, is not to write vaguer assessments (that would be a serious error, with criminal consequences of its own). The lesson is that the risk assessment, the applied agreement and the payslip must tell the same story, because they are now read together.

La scelta è tra due strade

The choice lies between two roads

Chi riceve una disposizione di questo tipo ha davanti due possibilità, e conviene guardarle insieme. La prima è impugnare: il provvedimento è contestabile in via amministrativa nei termini previsti dall’art. 14 del D.Lgs. n. 124/2004 e, in seguito, davanti al giudice amministrativo. È la strada che difende il principio, con il vantaggio di non creare un precedente interno all’azienda. La seconda è aprire il tavolo: adempiere alla disposizione avviando la contrattazione, dentro un perimetro che si negozia (importo, base di calcolo, durata, condizioni di riassorbimento, collegamento a misure organizzative).

Anyone receiving such a measure has two options, and they are best assessed together. The first is to challenge it: the measure can be contested administratively within the time limits set by art. 14 of Legislative Decree no. 124/2004 and thereafter before the administrative court. This route defends the principle and avoids creating an internal precedent. The second is to open the table: comply by starting negotiations, within a perimeter that is itself negotiable (amount, calculation base, duration, absorption clauses, links to organisational measures).

La prima strada appare istintivamente più solida, ma porta con sé un rischio che va messo sul tavolo: se la tesi dell’insufficienza retributiva regge nel merito, la stessa gravosità resta azionabile dai singoli lavoratori con domande individuali fondate sull’art. 36 della Costituzione, per il passato e senza il tetto che una contrattazione avrebbe potuto fissare. La disposizione, in questa prospettiva, è anche l’occasione di governare l’esposizione invece di subirla. È ragionevole ritenere che la scelta dipenda da due variabili concrete: quanto è documentata la gravosità nei propri atti interni e quanti rapporti di lavoro sono coinvolti. Chi scrive, con un DVR che qualifica il rischio come alto e una platea ampia, valuterebbe la seconda strada, ma la decisione resta di chi conosce i numeri dell’azienda.

The first road instinctively looks sounder, yet it carries a risk worth putting on the table: if the argument of insufficient pay holds on the merits, the same burden remains actionable by individual employees through claims based on art. 36 of the Constitution, for the past and without the cap that bargaining might have set. Seen this way, the measure is also an opportunity to manage the exposure rather than absorb it. It is reasonable to think that the choice turns on two concrete variables: how well the burden is documented in the company’s own records, and how many employment relationships are involved. In the writer’s view, with a risk assessment rating the risk as high and a broad group of workers, the second road deserves serious consideration, but the decision belongs to those who know the company’s figures.

Quattro controlli prima che arrivi l’ispezione

Four checks before the inspection arrives

(1) Incrociare il DVR e il DUVRI con il CCNL applicato: dove la valutazione interna segna un rischio alto o una condizione gravosa, verificare se il contratto la remunera. (2) Trattare prima la leva organizzativa (rotazione, pause di recupero, limiti di esposizione, dotazioni), che riduce il rischio e insieme l’argomento. (3) Mappare i CCNL di settori confinanti applicabili alla stessa mansione: sono il parametro che l’organo di vigilanza può usare. (4) Se una disposizione è già arrivata, calendarizzare subito il termine di impugnazione e, in parallelo, preparare il perimetro negoziale: le due strade non vanno decise all’ultimo giorno utile.

(1) Cross-check the risk assessment documents against the applied collective agreement: wherever the internal assessment marks a high risk or an onerous condition, verify whether the agreement pays for it. (2) Address the organisational lever first (rotation, recovery breaks, exposure limits, equipment), which reduces both the risk and the argument. (3) Map the collective agreements of neighbouring sectors covering the same duties: they are the benchmark the authority may use. (4) If a measure has already arrived, diarise the deadline for challenging it at once and, in parallel, prepare the negotiating perimeter: neither road should be chosen on the last available day.
