Il dehors sul marciapiede condominiale: quando basta la maggioranza semplice

Outdoor seating on the condominium pavement: when a simple majority is enough

Il bar al piano terra mette fuori sei tavoli da maggio a settembre. Il marciapiede davanti alla vetrina è condominiale, non comunale. L’assemblea approva a maggioranza, incassa un canone, e un condomino impugna sostenendo che l’area comune è stata sottratta al pari uso di tutti. Chi ha ragione?

The ground-floor café puts six tables outside from May to September. The pavement in front of the window belongs to the building, not to the municipality. The meeting approves by majority, collects a rent, and one owner challenges the resolution, arguing that common property has been withdrawn from everyone’s equal use. Who is right?

La domanda si presenta ogni primavera, e la risposta pesa: se la delibera richiede l’unanimità, o anche solo le maggioranze qualificate dell’art. 1120 c.c., l’esercizio commerciale è nelle mani di ogni singolo dissenziente. Se basta la maggioranza semplice, il locale ha una prospettiva di stagione su cui costruire il proprio conto economico.

The question comes round every spring, and the answer matters: if the resolution requires unanimity, or even the qualified majorities of art. 1120 of the Civil Code, the business is in the hands of every dissenting owner. If a simple majority is enough, the premises have a seasonal horizon on which to build their figures.

Sul punto è intervenuta la Corte di cassazione, Sezione II civile, con l’ordinanza n. 13618/2026, pubblicata l’11 maggio 2026.

The Court of Cassation, Second Civil Division, addressed the point in order no. 13618/2026, published on 11 May 2026.

Secondo la ricostruzione della pronuncia, l’assemblea condominiale può autorizzare, con le maggioranze ordinarie, la locazione stagionale di una porzione del marciapiede comune antistante un esercizio commerciale, destinata all’installazione di tavoli e sedie per la somministrazione.

On the reading given by the decision, the owners’ meeting may authorise, by ordinary majorities, the seasonal letting of a portion of the common pavement in front of a commercial unit, to be used for tables and chairs for food and drink service.

La decisione si fonda sulle caratteristiche concrete dell’utilizzazione: l’occupazione era limitata a cinque mesi all’anno, restava garantito un passaggio libero di un metro e mezzo e non si determinavano modificazioni stabili della struttura o della destinazione del bene comune.

The decision rests on the concrete features of the use: occupation was limited to five months a year, a clear passage of one and a half metres was preserved, and no stable alteration to the structure or designation of the common property arose.

La Corte ha così distinto l’uso indiretto della cosa comune, realizzato attraverso la locazione, dalle innovazioni disciplinate dall’art. 1120 c.c., escludendo che la concessione temporanea dell’area integrasse, nelle circostanze esaminate, un uso illegittimo ai sensi dell’art. 1102 c.c.

The Court thus distinguished indirect use of common property, achieved through letting, from the innovations governed by art. 1120 of the Civil Code, ruling out that the temporary grant of the area amounted, in the circumstances examined, to unlawful use under art. 1102.

La maggioranza è dunque sufficiente quando la locazione costituisca una modalità di gestione del bene comune, senza alterarne stabilmente la destinazione e senza pregiudicare il diritto degli altri condomini al pari uso.

A majority is therefore sufficient where the letting amounts to a way of managing the common asset, without stably altering its designation and without prejudicing the other owners’ right to equal use.

Dove sta davvero il rischio

Where the risk actually lies

Chi legge la massima come un via libera generalizzato allo «spazio esterno a maggioranza» rischia di sbagliare il punto. La pronuncia non libera un potere dell’assemblea: lo condiziona a tre dati di fatto misurabili. La limitazione temporale (nel caso deciso, cinque mesi l’anno). Il corridoio libero per il transito degli altri condòmini, di ampiezza adeguata (nel caso deciso, un metro e mezzo). L’assenza di una modificazione stabile della struttura o della destinazione.

Reading the ruling as a general green light for “outdoor space by majority” misses the point. The decision does not free up a power of the meeting: it conditions that power on three measurable facts. A limit in time (five months a year in the case decided). A free passage of adequate width for the other owners (one and a half metres in the case decided). The absence of any stable alteration to the structure or designation.

Il contenzioso, quindi, non si gioca sulla maggioranza: si gioca sul metro e mezzo e sui cinque mesi. Sono accertamenti di fatto, e si difendono con il rilievo planimetrico e le fotografie, non con l’argomento giuridico. È ragionevole ritenere che la stessa delibera, con un passaggio residuo di sessanta centimetri o con i tavoli lasciati tutto l’anno, avrebbe avuto sorte opposta.

The dispute, then, is not fought over the majority: it is fought over the metre and a half and the five months. These are findings of fact, defended with survey drawings and photographs rather than with legal argument. It is reasonable to consider that the same resolution, leaving sixty centimetres of passage or the tables in place all year round, would have met the opposite fate.

Tre letture che conviene mettere sul tavolo

Three readings worth putting on the table

La prima riguarda il conduttore, ed è scomoda. Ottenere lo spazio a maggioranza semplice è più facile, ma quello che si ottiene è fragile: una locazione stagionale deliberata a maggioranza può non essere rinnovata l’anno successivo con la stessa maggioranza. Chi costruisce il proprio conto economico estivo su quei sei tavoli sta appoggiando una voce di ricavo su un titolo annuale e revocabile. Un diritto di uso più stabile costerebbe molto di più in termini di maggioranze, ma reggerebbe nel tempo: chi tratta un rinnovo dovrebbe decidere quale delle due cose gli serve davvero, e dirlo prima di firmare.

The first concerns the tenant, and it is uncomfortable. Obtaining the space by simple majority is easier, but what is obtained is fragile: a seasonal lease approved by majority may fail to be renewed the following year by the same majority. A business building its summer figures on those six tables is resting a revenue line on an annual, revocable title. A more stable right of use would cost far more in terms of majorities, but would hold over time: anyone negotiating a renewal should decide which of the two they actually need, and say so before signing.

La seconda riguarda il canone, e va nella direzione opposta a quella che ci si aspetta. Il fatto che il condominio incassi un corrispettivo sembra un dettaglio contabile, e invece è l’elemento che qualifica il rapporto come uso indiretto della cosa comune anziché come mera tolleranza. Il canone protegge il conduttore, perché gli dà un titolo (e costringe l’assemblea a deliberare su un contratto, non su un favore). Il rovescio è che entra nel bilancio condominiale e diventa visibile a tutti, compreso il condomino che l’anno dopo vorrà discuterne l’importo.

The second concerns the rent, and it runs the opposite way to expectations. The fact that the building collects a payment looks like an accounting detail, yet it is precisely what characterises the arrangement as indirect use of common property rather than mere tolerance. The rent protects the tenant, because it gives him a title (and forces the meeting to resolve on a contract, not on a favour). The flip side is that it enters the building’s accounts and becomes visible to everyone, including the owner who will want to reopen the figure next year.

La terza è la più banale e la più frequente. La pronuncia riguarda un marciapiede condominiale. Dove l’area antistante è suolo pubblico, la delibera dell’assemblea non serve e non basta: serve la concessione comunale, con il suo regolamento, il suo canone e i suoi tempi. Capita spesso che i due titoli servano insieme, perché una parte dello spazio è comune e una parte è pubblica. La verifica catastale prima della trattativa costa poco; scoprirlo a tavoli montati costa molto di più.

The third is the most obvious and the most common. The decision concerns a pavement belonging to the building. Where the area in front is public land, the meeting’s resolution is neither needed nor sufficient: a municipal concession is required, with its own rules, fee and timing. The two titles are often needed together, because part of the space is common property and part is public. Checking the land registry before negotiating costs little; discovering the point once the tables are out costs a great deal more.

What to put in the contract

Nella scrittura fra condominio ed esercente conviene fissare per iscritto i tre elementi da cui dipende la tenuta della delibera: il periodo esatto dell’anno, la superficie occupata con planimetria allegata, e la larghezza minima del passaggio da mantenere libero. Aggiungere l’impegno del conduttore a rimuovere ogni struttura alla scadenza stagionale e a non eseguire opere fisse. Sono le tre cose su cui verterà l’eventuale impugnazione, ed è l’unico modo per farsi trovare con la prova già pronta.
The agreement between the building and the operator should set out in writing the three elements on which the resolution stands or falls: the exact period of the year, the surface occupied with an attached plan, and the minimum width of passage to be kept clear. Add the tenant’s undertaking to remove all structures at the end of the season and to carry out no fixed works. These are the three points any challenge will turn on, and this is the only way to have the evidence ready in advance.

Per chi gestisce reti retail o patrimoni immobiliari, l’indicazione pratica è una sola: lo spazio esterno non si negozia come un accessorio del locale, ma come un titolo a sé, con una sua durata e una sua fragilità. Trattarlo come una pertinenza scontata è ciò che porta, la primavera successiva, a scoprire che non lo era.

For those managing retail networks or property portfolios, the practical point is a single one: outdoor space is not negotiated as an accessory of the unit, but as a title in its own right, with its own duration and its own fragility. Treating it as a self-evident appurtenance is what leads, the following spring, to discovering that it was not.
