Care-home fees and long-term care: the 50% split is not an automatic rule

Una famiglia riceve dalla struttura il conto della retta: metà a carico del Servizio sanitario, metà a carico dell’ospite. La spiegazione arriva con tono di ovvietà: «nella lungoassistenza si divide al cinquanta per cento, è la tabella». Chi paga da anni si fida di quella frase. Ma la percentuale non nasce da una regola generale, e in certe condizioni cliniche allo stato parrebbe potersi sostenere che non abbia titolo per essere applicata.

A family receives the invoice from the care home: half charged to the National Health Service, half to the resident. The explanation comes as if self-evident: “in long-term care the cost is split fifty-fifty, that is what the schedule says”. Families who have paid for years take that sentence at face value. Yet the percentage does not stem from a general rule and, in certain clinical conditions, at this stage it would appear that it has no proper basis for being applied.

Il sistema distingue tre tipi di prestazioni (art. 3-septies del D.Lgs. 30 dicembre 1992, n. 502): quelle sanitarie a rilevanza sociale, a carico delle aziende sanitarie; quelle sociali a rilevanza sanitaria, di competenza dei Comuni con compartecipazione del cittadino; e quelle sociosanitarie ad elevata integrazione sanitaria, caratterizzate da particolare rilevanza terapeutica e intensità della componente sanitaria, erogate dalle aziende sanitarie e poste a carico del fondo sanitario (art. 3, commi 1, 2 e 3, del DPCM 14 febbraio 2001). Allo stesso decreto è allegata una tabella che, per la macroarea degli anziani non autosufficienti con patologie cronico-degenerative in fase di lungoassistenza, indica un riparto forfettario al cinquanta per cento tra Servizio sanitario e utente o Comune. È da quella tabella che nasce la percentuale citata negli uffici e nei contratti di ricovero.

The system distinguishes three types of service (art. 3-septies of Legislative Decree no. 502 of 30 December 1992): health services with social relevance, borne by the health authorities; social services with health relevance, falling to the municipalities with a contribution from the citizen; and social-health services with a high degree of health integration, marked by particular therapeutic relevance and intensity of the medical component, provided by the health authorities and charged to the health fund (art. 3, paragraphs 1, 2 and 3, of the Prime Ministerial Decree of 14 February 2001). Annexed to the same decree is a schedule which, for the macro-area of dependent elderly persons with chronic-degenerative conditions in the long-term care phase, sets a flat 50% split between the health service and the user or municipality. That schedule is the source of the percentage quoted in offices and admission contracts.

Il rischio, per le famiglie, non è teorico. Nei ricoveri di lunga durata la quota mensile a carico dell’ospite può accumularsi in cifre molto rilevanti, versate nella convinzione che si tratti di un obbligo di legge. Sul fronte opposto c’è un rischio simmetrico, che è giusto dire: chi legge una sentenza favorevole e ne ricava l’idea che «in RSA non si paga nulla» sbaglia allo stesso modo. La qualificazione della prestazione non è automatica e non dipende dall’età né dal nome della diagnosi: richiede un accertamento in fatto, caso per caso, dell’intensità della componente sanitaria e della sua inscindibilità da quella assistenziale. Risulta del resto che vi siano pronunce di merito le quali, nella pura lungoassistenza con prestazioni sanitarie di intensità modesta, continuano ad applicare il riparto forfettario. For families the risk is not theoretical. In long stays the monthly share charged to the resident can add up to very substantial figures, paid in the belief that this is a statutory obligation. On the other side there is a symmetrical risk, which is only fair to state: anyone who reads a favourable judgment and concludes that “nothing is payable in a care home” is equally mistaken. The classification of the service is not automatic and does not depend on age or on the name of the diagnosis: it calls for a factual assessment, case by case, of the intensity of the medical component and of its inseparability from the care component. It also appears that lower-court decisions remain which, in pure long-term care with modest medical input, continue to apply the flat split. Il principio: la tabella non deroga alla norma

The principle: the schedule does not override the rule

Il punto tecnico è il rapporto tra la norma e la tabella. Secondo la lettura che pare preferibile, e che la giurisprudenza di legittimità parrebbe aver di recente valorizzato, la disposizione di riferimento resta l’art. 3, comma 3, del DPCM 14 febbraio 2001, il quale prevede che le prestazioni ad elevata integrazione sanitaria siano a totale carico del fondo sanitario «anche nelle fasi estensive e di lungoassistenza». La tabella allegata attua una diversa previsione dello stesso decreto, rivolta alle Regioni: è ragionevole ritenere, dunque, che non possa derogare al principio generale posto dal comma 3. Se la prestazione è ad elevata integrazione sanitaria, il fatto che il ricovero sia entrato nella fase di lungoassistenza non pare di per sé ragione sufficiente per dividere il costo a metà.

The technical point is the relationship between the rule and the schedule. On what appears to be the preferable reading, which the Supreme Court would seem to have recently given weight to, the governing provision remains art. 3, paragraph 3, of the Decree of 14 February 2001, under which services with a high degree of health integration are wholly charged to the health fund “including in the extensive and long-term care phases”. The annexed schedule implements a different provision of the same decree, addressed to the Regions: it is therefore reasonable to hold that it cannot override the general principle laid down in paragraph 3. Where the service has a high degree of health integration, the mere fact that the stay has entered the long-term care phase does not in itself appear a sufficient reason to halve the cost.

La fase del ricovero non cambia la natura della prestazione. Se la componente sanitaria è intensa e inscindibile da quella assistenziale, allo stato parrebbe potersi sostenere che il costo resti a carico del fondo sanitario anche nella lungoassistenza.
The phase of the stay does not change the nature of the service. Where the medical component is intense and inseparable from the care component, at this stage it would appear that the cost remains with the health fund even in long-term care.

Un secondo passaggio merita attenzione, perché sposta l’onere della prova. Nelle patologie neurodegenerative avanzate l’assenza di un piano terapeutico personalizzato formalizzato pare non poter costituire, da sola, l’elemento decisivo per negare l’inscindibilità: le disabilità che derivano da quei quadri clinici renderebbero di per sé ragionevolmente desumibile la necessità di prestazioni ad elevata integrazione. Il piano resta un elemento probatorio utile e va cercato nel fascicolo sanitario, ma la sua mancanza materiale non pare risolutiva quando la condizione clinica parla da sola. Questa è una precisazione che riguarda direttamente le famiglie a cui, in passato, è stato risposto che «senza il PAI non si può contestare nulla».

A second step deserves attention, because it shifts the burden of proof. In advanced neurodegenerative conditions the absence of a formalised personalised treatment plan appears unable, on its own, to be the decisive factor for denying inseparability: the disabilities flowing from those clinical pictures would arguably make the need for highly integrated services reasonably inferable in itself. The plan remains useful evidence and should be sought in the medical file, but its physical absence does not appear conclusive where the clinical condition speaks for itself. This is a clarification that directly concerns families who were previously told that “without the care plan nothing can be challenged”.

Le due conseguenze pratiche

Two practical consequences

La prima riguarda il contratto di ricovero. Le clausole che pongono a carico dell’ospite o dei familiari quote di compartecipazione relative a prestazioni che la legge assegna al fondo sanitario risultano essere state ritenute nulle, in alcune pronunce, per contrasto con norme imperative: la ragione che pare emergere è che non si assuma validamente in via privata un’obbligazione che l’ordinamento pone in capo a un ente pubblico. La seconda riguarda il passato: le somme versate senza titolo possono essere richieste in restituzione a titolo di indebito oggettivo (art. 2033 c.c.), verso l’ente tenuto al pagamento integrale. Qui il tempo pesa: il termine di prescrizione, in linea con l’orientamento che pare preferibile, è quello ordinario decennale e va calcolato sui singoli versamenti, cosicché ogni mese di attesa può erodere la parte più antica della pretesa. È l’aspetto che, nella pratica, fa la differenza tra una richiesta piena e una richiesta dimezzata.

The first concerns the admission contract. Clauses charging the resident or the family with contribution shares relating to services that the law assigns to the health fund appear to have been held void, in some decisions, for conflict with mandatory rules: the reasoning that seems to emerge is that one may not validly assume by private agreement an obligation which the legal system places on a public body. The second concerns the past: sums paid without a legal basis may be claimed back as undue payment (art. 2033 of the Civil Code), from the body bound to pay in full. Here time matters: the limitation period, on what appears to be the preferable view, is the ordinary ten-year term and runs on each individual payment, so every month of delay can erode the oldest part of the claim. In practice this is what makes the difference between a full claim and a halved one.

C’è poi un angolo controintuitivo che vale la pena mettere sul tavolo. La strada che a prima vista pare più comoda — smettere di pagare la retta e attendere — è spesso la più fragile: espone al rischio di azioni per il recupero e, in qualche caso, alla contestazione della permanenza nella struttura, con un costo umano che nessuna ragione giuridica compensa. La strada meno intuitiva, ma di norma più solida, è continuare a versare quanto richiesto contestando per iscritto il titolo e chiedendo la restituzione: si preserva la posizione del familiare ricoverato e si evita di consegnare alla controparte l’argomento dell’inadempimento. Un secondo angolo, meno gradito: non ogni ricovero in RSA rientra in questo perimetro, e presentare come diritto acquisito ciò che dipende da un accertamento clinico significa esporre la famiglia a una delusione e a spese processuali evitabili.

There is also a counter-intuitive angle worth putting on the table. The course that looks easiest — stopping payment of the fee and waiting — is often the most fragile: it invites recovery proceedings and, in some cases, a challenge to the resident’s continued stay, at a human cost no legal argument makes up for. The less intuitive but usually sounder course is to keep paying what is demanded while challenging the basis in writing and seeking restitution: this protects the position of the family member in care and avoids handing the other side an argument based on default. A second angle, less welcome: not every care-home stay falls within this perimeter, and presenting as an acquired right something that depends on a clinical assessment exposes the family to disappointment and to avoidable litigation costs.

(1) La cartella clinica: quadro diagnostico, presidi in atto (nutrizione artificiale, tracheostomia, monitoraggio continuo, terapie complesse), eventuale piano assistenziale individuale. (2) Il contratto di ricovero: chi ha firmato, in quale qualità, quali clausole pongono la retta a carico dei familiari. (3) La contabilità: elenco dei versamenti con data e importo di ciascuno, che è la base per calcolare la prescrizione. (4) L’interlocutore corretto: l’azienda sanitaria territorialmente competente, la struttura, o entrambe. (1) The medical file: diagnosis, devices and treatments in place (artificial nutrition, tracheostomy, continuous monitoring, complex drug regimens), and any individual care plan. (2) The admission contract: who signed it, in what capacity, and which clauses place the fee on family members. (3) The payment record: a list of payments with the date and amount of each, which is the basis for calculating limitation.
