In assemblea il rendiconto dell’amministratore viene spesso approvato in pochi minuti: i numeri tornano, il saldo è quello atteso, si passa oltre. Una recente sentenza del Tribunale di Torino ricorda che un bilancio esatto ma poco leggibile non basta. Se il condòmino non riesce a capire come stanno davvero le cose, la delibera che approva quel rendiconto può essere annullata.
At the meeting, the administrator’s account is often approved within minutes: the figures add up, the balance is the expected one, and everyone moves on. A recent ruling of the Court of Turin recalls that an accurate but hard-to-read statement is not enough. If the unit owner cannot understand how things actually stand, the resolution approving that account can be voided.

Capita spesso che il rendiconto arrivi in assemblea come un unico foglio di totali, o come una somma di voci senza il dettaglio dei movimenti, senza lo stato dei crediti verso i condòmini morosi e dei debiti verso i fornitori, senza una spiegazione delle partite ancora aperte. I conti magari quadrano, ma il partecipante non è in grado di verificare se le quote incassate corrispondono alle spese pagate, quanto resta nei fondi, quali contenziosi pesano sulla gestione. È una situazione che si presenta in molti condomìni, e che di solito passa inosservata finché qualcuno non decide di guardare i conti da vicino.
It often happens that the account reaches the meeting as a single sheet of totals, or as a list of items with no detail of the transactions, no statement of amounts due from defaulting owners and payable to suppliers, no explanation of the items still open. The figures may balance, yet the owner cannot check whether the contributions collected match the expenses paid, how much is left in the funds, or which disputes weigh on the management. This recurs in many buildings, and usually goes unnoticed until someone decides to look at the accounts closely.

Il Tribunale di Torino (sezione VIII, sentenza 13 luglio 2026 n. 4300) muove dall’art. 1130-bis c.c., secondo cui il rendiconto contiene le voci di entrata e di uscita e ogni altro dato sulla situazione patrimoniale del condominio, sui fondi disponibili e sulle riserve, espressi «in modo da consentire l’immediata verifica». La contabilità, osserva il giudice, non deve essere soltanto corretta sul piano sostanziale: deve anche essere chiara e intelligibile, cioè controllabile da chi la legge. È questa la ragione stessa della norma, rendere la gestione trasparente per i condòmini.
The Court of Turin (Eighth Section, judgment of 13 July 2026 no. 4300) starts from art. 1130-bis of the Civil Code, under which the account contains the items of income and expenditure and every other datum on the condominium’s financial position, available funds and reserves, expressed “so as to allow immediate verification”. The accounts, the court notes, must not only be substantively correct: they must also be clear and intelligible, that is, capable of being checked by the reader. This is the very purpose of the rule, to make the management transparent for the owners.
In concreto, la legge impone una sola rendicontazione annuale, ma composta da tre documenti distinti e non separabili tra loro. Il registro di contabilità (o libro di cassa) annota i movimenti di entrata e di uscita in ordine cronologico, così da riscontrare le quote incassate da ciascun condòmino e le somme pagate ai fornitori. Il riepilogo finanziario (o stato patrimoniale) fotografa attivo e passivo tenendo conto anche delle gestioni precedenti, e vi confluiscono le quote non ancora riscosse e gli impegni di spesa non evasi. La nota esplicativa, infine, racconta i tratti salienti della gestione, i rapporti in corso e le questioni pendenti.
In practice, the law requires a single annual account, but made up of three distinct documents that cannot be separated from one another. The accounting register (or cash book) records income and expenditure in chronological order, so as to reconcile the contributions collected from each owner with the sums paid to suppliers. The financial summary (or balance sheet) captures assets and liabilities, taking earlier years into account, and gathers the contributions not yet collected and the spending commitments still open. The explanatory note, lastly, sets out the salient features of the management, the ongoing relationships and the pending matters.
La conseguenza pratica è netta. Se manca uno di questi documenti, o se l’insieme non consente ai partecipanti di comprendere entrate, spese e fondi disponibili, la delibera che approva il rendiconto può essere annullata. E ciò a prescindere dal diritto, sempre spettante al singolo, di prendere visione ed estrarre copia dei documenti giustificativi di spesa: sono due tutele distinte, non l’una in sostituzione dell’altra.
The practical consequence is clear-cut. If one of these documents is missing, or if the set does not allow the owners to grasp income, expenses and available funds, the resolution approving the account can be voided. And this applies regardless of the owner’s ever-present right to inspect and obtain copies of the supporting expense documents: these are two distinct protections, not one in place of the other.
L’angolo che si trascura: la forma perfetta non è la garanzia

Qui sta il punto controintuitivo. Il rischio non è quasi mai un errore aritmetico plateale, che salterebbe subito all’occhio: è il rendiconto formalmente ordinato, con i totali al loro posto, che però non permette di ricostruire la storia dei conti. Un bilancio «bello» può rassicurare e coprire proprio quel che andrebbe verificato. Vale anche il rovescio, ed è utile all’amministratore diligente: la sentenza chiarisce che la correttezza sostanziale dei conti non basta a sanare l’incompletezza formale. Anche quando i conti risultano corretti, la delibera resta annullabile se il rendiconto non è composto dai tre documenti richiesti dall’art. 1130-bis c.c. — registro di contabilità, riepilogo finanziario e nota esplicativa — perché è proprio quella struttura a permettere ai condòmini una verifica immediata e consapevole prima del voto.
Here lies the counterintuitive point. The risk is almost never a glaring arithmetical error, which would stand out at once: it is the formally tidy account, with totals in their place, that nonetheless does not let the owner reconstruct the story of the accounts. A “handsome” balance can reassure and mask precisely what should be checked. The reverse also holds, and it helps the diligent administrator: the ruling makes clear that substantive correctness of the accounts is not enough to cure a formal gap. Even when the figures check out, the resolution remains voidable if the account is not made up of the three documents required by art. 1130-bis of the Civil Code — accounting register, financial summary and explanatory note — because it is precisely that structure that lets owners carry out an immediate, informed check before voting.

What to check before approving (or challenging)
Per l’amministratore: portare in assemblea tutti e tre i documenti (registro di contabilità, riepilogo finanziario e nota esplicativa), curando che il riepilogo evidenzi crediti verso i morosi e debiti verso i fornitori, e che la nota spieghi le partite ancora aperte. Per il condòmino: prima di votare, verificare che dai documenti si capiscano entrate, uscite, fondi e criteri di riparto; se il quadro resta oscuro, chiedere a verbale i chiarimenti e valutare l’impugnazione della delibera, che va proposta nei termini di legge per gli assenti e i dissenzienti (art. 1137 c.c.). La data esatta di decorrenza va sempre verificata sul caso concreto prima di agire.
For the administrator: bring all three documents to the meeting (accounting register, financial summary and explanatory note), making sure the summary highlights amounts due from defaulters and payable to suppliers, and that the note explains the items still open. For the owner: before voting, check that the documents make income, expenditure, funds and allocation criteria understandable; if the picture stays obscure, ask for clarification on the record and consider challenging the resolution, which absent or dissenting owners must bring within the statutory time limit (art. 1137 of the Civil Code). The exact starting date must always be verified in the specific case before acting.
La regola vale ben oltre il condominio. In ogni rendicontazione, dal mandato all’amministrazione di beni altrui, la trasparenza non è un vezzo formale: è la condizione perché chi deve controllare possa farlo. Un conto che nessuno riesce a leggere è un conto che, nel momento della lite, si difende male.
The rule reaches well beyond the condominium. In any account-giving, from a mandate to the administration of another’s assets, transparency is no formal flourish: it is the condition that lets whoever must review actually do so. An account no one can read is an account that, when a dispute comes, defends itself poorly.
