Cartellone pubblicitario sulla facciata: quando l’assemblea non può autorizzarlo

Advertising sign on the facade: when the condominium meeting cannot authorise it

Un’azienda affitta uno spazio sulla facciata di un palazzo e vi monta un grande cartellone. L’assemblea aveva detto sì, il contratto durava sei anni, i soldi entravano nelle casse del condominio. Poi un condomino fa causa, e il conto lo paga proprio il condominio. Una recente sentenza del Tribunale di Napoli spiega dove si è rotto il ragionamento.

A company rents space on a building’s facade and puts up a large advertising sign. The meeting had said yes, the contract ran for six years, the money flowed into the building’s account. Then one owner sues, and it is the condominium that foots the bill. A recent ruling of the Court of Naples explains where the reasoning broke down.

Il problema: la maggioranza in assemblea basta?

The problem: is a majority vote in the meeting enough?

La scena si ripete spesso. Un operatore pubblicitario, o l’attività commerciale al piano terra, propone al condominio di sfruttare la facciata: un maxi-cartellone o un’insegna di grandi dimensioni, in cambio di un canone. L’assemblea vede un’entrata, delibera a maggioranza e firma un contratto pluriennale. Il presupposto implicito è che, se la maggioranza approva e l’installazione è temporanea, il problema non si pone. È un presupposto fragile, perché c’è un limite che nessuna maggioranza può superare da sola: il decoro architettonico dell’edificio.

The scene recurs often. An advertising operator, or the ground-floor business, offers the building the chance to exploit the facade: a large billboard or an oversized sign, in exchange for a fee. The meeting sees income, votes it through by majority and signs a multi-year contract. The implicit assumption is that, if the majority approves and the installation is temporary, there is no issue. That assumption is fragile, because there is a limit no majority can cross on its own: the building’s architectural decorum.

Il Tribunale di Napoli (sentenza n. 10920, pubblicata il 29 giugno 2026) parte da una regola nota ma spesso ignorata: l’installazione di un cartellone di notevoli dimensioni sulla facciata può integrare un’innovazione vietata ai sensi dell’art. 1120 c.c. quando altera in modo apprezzabile il decoro architettonico.

The Court of Naples (judgment no. 10920, published on 29 June 2026) starts from a well-known but often ignored rule: installing a sizeable sign on the facade may amount to a prohibited innovation under art. 1120 of the Civil Code when it appreciably alters architectural decorum.

Nel caso deciso, la consulenza tecnica aveva accertato che il manufatto avrebbe coperto circa il 40% dell’intera facciata e oltre il 70% della larghezza del prospetto, con materiali — lamiera zincata e telo in PVC — in contrasto con il rivestimento originario. Non un dettaglio, ma una modifica dell’identità visiva dell’edificio. A rafforzare il divieto c’era anche il regolamento condominiale, che vietava qualsiasi opera idonea ad alterare l’estetica del fabbricato.

In the decided case, the expert had established that the structure would cover about 40% of the whole facade and over 70% of the elevation’s width, with materials — galvanised sheet metal and pvc sheeting — clashing with the original cladding. Not a detail, but a change to the building’s visual identity. Reinforcing the ban was also the building regulation, which prohibited any work capable of altering the building’s appearance.

“Ma è temporaneo” e “c’era già un’insegna”: due difese che non reggono

“But it’s temporary” and “there was already a sign”: two defences that fail

Il condominio si era difeso su due fronti, entrambi respinti. Primo: il contratto di locazione pubblicitaria era «a tempo». Ma la durata era di sei anni, rinnovabile, periodo tutt’altro che trascurabile e idoneo a incidere anche sul valore commerciale delle singole unità immobiliari; la natura temporanea, di per sé, non esclude la lesione del decoro.

The building had defended on two fronts, both rejected. First: the advertising lease was «for a limited time». But its term was six years, renewable, a far from negligible period and capable of affecting the commercial value of the individual units too; being temporary does not, in itself, rule out harm to decorum.

Secondo: sulla facciata c’erano già stati altri mezzi pubblicitari e un’insegna commerciale. Anche qui il Tribunale osserva che le precedenti alterazioni non creano un diritto a nuove modifiche incompatibili con il decoro. In altre parole, un’insegna tollerata ieri non è il lasciapassare per il cartellone di oggi.

Second: the facade had already carried other advertising and a commercial sign. Here too the Court observes that past alterations create no right to new changes incompatible with decorum. In other words, a sign tolerated yesterday is not a pass for today’s billboard.

L’angolo che si trascura: il condominio perde anche se il cartellone non si monta

The angle that gets missed: the building loses even if the sign is never put up

Qui la pronuncia diventa istruttiva. Durante la causa è arrivato il diniego della Soprintendenza, poiché l’edificio era tutelato, che ha reso impossibile realizzare il cartellone. Verrebbe da pensare: problema risolto, il condomino non ha più nulla da annullare.

Here the ruling becomes instructive. During the case the Heritage Authority refused its consent, since the building was listed, making the sign impossible to build. One would think: problem solved, the owner has nothing left to annul.

Il Tribunale ragiona all’opposto. Venuto meno l’interesse ad annullare una delibera ormai priva di effetti, ha comunque applicato il principio della soccombenza virtuale. La soccombenza virtuale consente al giudice di regolare le spese di lite sulla base dell’esito che la controversia avrebbe presumibilmente avuto se fosse stata decisa nel merito.

The Court reasons the opposite way. With the interest in annulling a now ineffective resolution gone, it still applied the principle of virtual defeat. Virtual defeat allows the court to allocate the costs of the case on the basis of the outcome the dispute would presumably have had, had it been decided on the merits.

Nel caso concreto, se la causa fosse proseguita, il condomino avrebbe vinto, perché la delibera era illegittima già in partenza. Risultato: il condominio è stato condannato a rifondere al condomino le spese di lite e quelle della consulenza tecnica.

In the specific case, had the proceedings continued, the owner would have won, because the resolution was unlawful from the start. Result: the building was ordered to reimburse the owner’s litigation costs and the expert’s fees.

La delibera sbagliata è costata, anche senza che il cartellone vedesse mai la luce. È il rovescio contro-intuitivo della vicenda: non conta soltanto se l’opera venga effettivamente realizzata, ma anche che l’assemblea abbia deliberato oltre i propri limiti.

The wrong resolution came at a price, even though the sign never appeared. This is the counter-intuitive twist: it matters not only whether the work is actually built, but also that the meeting resolved beyond its powers.

Per l’impresa o l’operatore che vuole lo spazio: (1) verificare il regolamento condominiale e i limiti al decoro prima di investire in struttura e stampa; (2) misurare l’opera sulla facciata — proporzioni, materiali e colori — perché, quanto più è invasiva, tanto più elevato è il rischio di rimozione; (3) se l’edificio è tutelato, mettere in conto il nulla osta della Soprintendenza, che può bloccare tutto; (4) non fidarsi della formula «è temporaneo»: un contratto pluriennale può incidere stabilmente sull’aspetto dell’edificio.

For the business or operator seeking the space: (1) check the building regulation and the limits on decorum before investing in the structure and print; (2) size the work against the facade — proportions, materials and colours — because the more invasive it is, the higher the removal risk; (3) if the building is listed, factor in the Heritage Authority’s consent, which can stop everything; (4) do not trust the «it’s temporary» label: a multi-year contract can affect the building’s appearance on a lasting basis.

Per il condominio e l’amministratore: una maggioranza non sana un’innovazione che lede il decoro ai sensi dell’art. 1120 c.c. e una delibera illegittima può comportare la condanna alle spese di lite anche se l’opera non viene mai realizzata. Conviene, quindi, istruire la delibera mediante una valutazione tecnica preventiva. La scelta finale, con i suoi numeri e i suoi rischi, resta di chi decide.

For the building and its manager: a majority does not cure an innovation that harms decorum under art. 1120 of the Civil Code, and an unlawful resolution can lead to an order to pay litigation costs even if the work is never built. It is therefore worth preparing the resolution with a prior technical assessment. The final choice, with its figures and risks, remains with those who decide.
