The tenant settles the arrears on the day of the confirmation hearing and the debt disappears from the ledger. Many landlords treat the matter as closed and withdraw the eviction. A recent ruling of the Court of Rome shows that the case is in fact decided not on the final balance, but on the history of delays that preceded it.
The case: a transfer of a business branch and eight months without rent
The lease dated back to 2014, at a monthly rent of 1,150.00 euro. In 2019 a different company stepped into the contract through a transfer of a business branch: an ordinary event in retail, where the premises follow the business and the lease changes hands without the landlord being able to object. From June 2025 the tenant stopped paying. The landlord served an eviction notice for arrears; the tenant appeared, opposed confirmation and paid the sums claimed shortly before the hearing, but after proceedings had been joined. The judge refused the interim release order and converted the proceedings, sending the case to full trial.
La sanatoria che non sana: l’art. 1453, terzo comma
The cure that does not cure: article 1453, third paragraph
The Court starts from article 1453, third paragraph, which bars the debtor from performing after a claim for termination has been brought. It follows that payment made after the eviction notice — which already contains that claim — does not prevent the court from assessing the gravity of the earlier breach in the proceedings that continue. The ruling cites Cass. 7 March 2001, no. 3341 and Cass. civ., III, no. 8550/1999. At this stage it would appear that the dividing line is not how much was paid, but when: before or after proceedings were joined.
How gravity is measured: not the loss, but the contract’s balance
This is the passage most worth taking into the courtroom. Under article 1455, the gravity of a breach «is not to be measured solely by the extent of the loss, which may not even exist, but by the significance of the breach» in light of the parties’ intention, the nature and purpose of the relationship and the other party’s actual interest in exact and timely performance. The assessment extends to performance in good faith under article 1375 (Cass. civ., III, no. 19879/2011) and gives weight to the «prolonged, repeated and closely spaced» delays preceding the arrears complained of. In a lease, after all, payment of rent is the primary obligation: on the line of authority cited, a breach of that obligation is treated as implicitly significant.
The other side of the coin, which concerns the landlord
It would be a partial reading, however, to conclude that the landlord should always let the proceedings run. In the Rome case, payment of the arrears produced a precise and unwelcome effect: taking note of the settlement, the judge refused the interim release order and converted the proceedings. The tenant stayed in the premises, and by the judgment — over a year after the arrears began — the rent debt had climbed back to 15,082.00 euro, on a rent meanwhile raised to 1,450.00 euro per month. The landlord won: termination declared, release by 9 November 2026, condemnation to rents due and accruing, costs assessed at 2,010.00 euro. But he waited. The preferable reading appears to be that accepting the cure is neither a defeat nor a shortcut: it shifts the centre of gravity from swift release to a decision on the merits, with the delay that entails.
Gravity is documented beforehand, not improvised at the hearing
Anyone managing a portfolio of shops or a unit in a shopping centre faces two routes, and the difference between them is decided by the documents gathered in the preceding months. (1) Keep a written record of every delay and every reminder, even when the rent eventually arrives: it is that sequence that sustains a finding of gravity. (2) Decide before the hearing whether to accept the cure or still seek the release order, knowing that accepting payment may lengthen the proceedings. (3) Where the relationship arises from a transfer of a business branch, reconstruct the payment history for the predecessor’s period too, because the contract is the same one. The choice remains the client’s: our task is to put the cost and the timing of each on the table.
