Passano mesi, a volte anni.
On admission day the facility puts the admission contract on the table. The parent is not able to sign, or signs with difficulty, and the son or daughter signs where told. Months go by, sometimes years. Then a letter arrives: there are arrears, and the facility is asking them to pay.
Il problema: una firma, tre ruoli diversi
The problem: one signature, three different roles
Oppure può aver firmato come obbligato in solido, cioè come secondo debitore accanto all’ospite, e la struttura può rivolgersi indifferentemente all’uno o all’altro.
On an admission contract a relative’s signature can mean very different things, and the difference almost always lies in a line nobody read. The child may have signed on the parent’s behalf, as their representative (for instance as support administrator or under a power of attorney): in that case the parent remains the debtor. They may have signed personally, as guarantor: they then answer for someone else’s debt, within the limits of the guarantee. Or they may have signed as joint and several obligor, a second debtor alongside the resident, and the facility can turn to either.
Forms often blend these formulas: “the undersigned, as the reference family member, undertakes to pay”. Reading that clause carefully is the first step, before even discussing the amount.
The risk: paying on a basis that may not hold
The arrears letter usually arrives when the debt is already substantial, in a tone that takes the obligation for granted. Whoever pays at once, or signs a repayment plan, risks acknowledging a debt that on paper could have been disputed. And there is a second level, often overlooked: before asking who must pay, it is worth asking how much was really due, because part of the fee, where healthcare services prevail, might fall on the National Health Service.
The principle: a guarantee for future fees needs a cap
The fees for the months after admission are debts that do not yet exist when the contract is signed. The Civil Code allows a future obligation to be guaranteed, but on one condition: Article 1938 of the Civil Code requires, in that case, the maximum guaranteed amount to be stated. Case law also accepts an amount that can be determined on the basis of certain criteria set out in the contract. If, however, the form merely says the relative “guarantees payment of the fees”, without any limit, at this stage it would appear arguable that the guarantee is open to a challenge on validity.
There are also two rules on the duration of the guarantee that can matter in long stays. Under Article 1956 of the Civil Code the guarantor of a future debt is released if the creditor keeps extending credit while knowing that the debtor’s finances have deteriorated to the point of making payment much more difficult, without the guarantor’s specific authorisation; and this protection cannot be waived in advance. Under Article 1957 of the Civil Code, by contrast, the guarantor remains bound after the due date only if the creditor has acted against the debtor within six months; this rule, however, can be set aside by contract, and forms often do so. These are points to be checked against the text and the facts, case by case.
A different matter is the children’s duty to provide maintenance to a parent in need, under Article 433 of the Civil Code: it arises from the law, has its own requirements and is measured on the means of both giver and recipient. It does not coincide with the fee on the invoice, and it should not be confused with the signature on the contract.
Un punto che ribalta l’impostazione
A point that turns the usual view around
Faced with arrears, the instinct is to settle quickly: a repayment plan, a signature, a few instalments. Yet the most dangerous document is often the one signed afterwards, even more than the contract of admission day. An acknowledgment of debt or a new payment undertaking can cure the very weaknesses of the original contract, because it states the amount and the signatory’s role. For this reason, until the papers have been read, I would not sign anything new.

Retrieve the admission contract with all annexes and the facility’s rules, the invoices, the social-health ISEE and the multidimensional assessment report. Find the clause describing your role and check whether it states a maximum amount. Do not pay or sign repayment plans before having them read: the reply to the facility is written afterwards, and it changes a great deal depending on how you signed.
