A unit separate from the condominium building, a number of disputed expenses and proceedings to establish that no condominium relationship exists. After two instances, the Supreme Court declares both judgments void: not all the individual owners had been joined. A decision that shows how important it is to frame a dispute correctly from the outset.

Italian Supreme Court, Second Civil Chamber, order of 23 October 2026, no. 27653.
The case: a unit separate from the building, yet included in the condominium expenses
The dispute arose in Genoa, where the owner of a flat and of a unit situated on the opposite side of a small square from the condominium building challenged the inclusion of that unit in the condominium. In the owner’s view, the unit was physically separate from the building and shared with it only the water system and a private square. Moreover, the original millesimal tables did not include the unit, which was subsequently taken into account in the expense allocations approved by the general meeting resolutions of 18 November 2014 and 14 December 2015.
The owner therefore brought proceedings against the condominium, seeking a declaration that the unit was not part of it and, as a consequence, that the resolutions including it in the expense allocations were void. The Court of Genoa dismissed the claim. The Court of Appeal, by contrast, found for the owner, holding that the unit was not part of the condominium and that the resolutions treating it as such were void.
The matter thus appeared to have ended in the owner’s favour. The condominium, however, appealed to the Supreme Court.
La Cassazione: non bastava citare l’amministratore
The Supreme Court: suing the administrator was not enough
By order no. 27653/2026, the Supreme Court upheld the ground of appeal concerning the failure to join all the individual owners. The central issue is not, at least at this stage, whether the unit actually belongs to the condominium, but the correct identification of the parties against whom the claim had to be brought.
The owner had not confined herself to challenging individual condominium charges. She had asked the court to declare, with the force of res judicata, that her property was not part of the condominium. In the Supreme Court’s view, a claim of this kind directly affects the individual owners’ rights in rem over the common parts. Consequently, it is not enough to sue the condominium as represented by its administrator: all the individual owners must take part in the proceedings as necessary parties under art. 102 of the Code of Civil Procedure.
The reason is that the decision affects the extent of the property rights, whether common or exclusive, of the individual participants in the condominium, and therefore cannot be handed down with the force of res judicata without their involvement.
La distinzione fondamentale: accertamento principale e accertamento incidentale
The key distinction: principal determination and incidental determination
The Supreme Court clarifies a point of particular importance in the handling of condominium disputes. Not every case in which the membership of a property in the condominium is discussed necessarily requires the participation of all the individual owners. Two situations must be distinguished.
Where the membership of a property in the condominium is examined only incidentally, as a preliminary question necessary to decide another claim, the proceedings may be conducted against the condominium as represented by its administrator. Conversely, where a party expressly seeks a ruling intended to be conclusive as to the existence or non-existence of the condominium relationship, all the individual owners must be joined.
The difference may appear subtle, but the procedural consequences are decisive. What matters is not only the substantive matter in dispute: the wording of the claims made and the legal effects sought from the judgment take on particular importance.
A procedural error that can undo years of litigation
In the case examined, proceedings had been commenced before the Court of Genoa and had ended, on appeal, with a judgment in the owner’s favour in March 2022. Only in October 2026, following the condominium’s appeal, did the Supreme Court find that not all the necessary parties had taken part.
The consequence was substantial. The Supreme Court declared both the first-instance and the appeal judgments void, remitting the case to the Court of Genoa before a different judge. The proceedings must therefore be resumed within the statutory time limits, with the participation of all the individual owners.
The Supreme Court did not decide whether the unit should in fact be regarded as part of the condominium, nor did it finally resolve the question of the disputed expenses. What it found was a procedural defect capable of overturning both decisions on the merits. An error in identifying the necessary parties thus made it necessary to start again at first instance, after years of litigation and with further costs and delays to face.
Why legal advice matters before proceedings even begin
The ruling offers a lesson that goes beyond the specific case. In condominium disputes, framing the action correctly is as important as the merits of the underlying case. Before commencing proceedings one must assess not only which rights are to be protected, but also which claim to bring, which effects are sought from the decision and which parties must necessarily take part.
A challenge concerning the payment of particular condominium expenses may indeed rest on procedural conditions different from those of a claim seeking a final determination that no condominium relationship exists. The choice must be made in the light of the result the client actually pursues, the documents available and the possible consequences of the ruling.
In this context, timely legal advice makes it possible to examine in advance the titles of ownership, the condominium regulations, the millesimal tables, the general meeting resolutions and the configuration of the common parts, identifying the most appropriate procedural strategy. The aim is not merely to obtain a favourable decision, but to prevent a flaw in the construction of the claim from compromising the entire proceedings.
Chi va chiamato in causa, e quando
Who must be joined, and when
Order no. 27653/2026 confirms that a claim seeking a determination, with the force of res judicata, that no condominium relationship exists must be brought against all the individual owners. Where instead the question of membership in the condominium is addressed solely on an incidental basis, proceedings may be brought against the administrator. The failure to join a necessary party renders the proceedings void, a defect the court may raise of its own motion at any stage.
The case therefore confirms a principle of fundamental practical importance: even a potentially well-founded claim may meet decisive obstacles where the proceedings are not correctly framed from the outset. For this reason, in disputes concerning ownership, the membership of property in the condominium and the allocation of expenses, assessing the litigation strategy in advance is an essential step in protecting the client’s interests effectively.
